Town Green Result
Following the Public Inquiry which started in April, adjourned to June and for which the promised report in August was long overdue, the Report eventually arrived on the 14th October with Oxfordshire County Council.
The report comprising 63 Pages, concluded as follows:
I conclude that the applicant has failed to prove that the application land or any part of the application land is registrable as a new green.
I recommend that the application is rejected. It is necessary under reg. 8(1) of the 1969 Regulations for the registration authority to give the applicant written reasons for rejection. I recommend that the reasons are stated to be “the reasons given in the Inspector's Report of 13 th . October 2007”.
At a meeting of supporters on the 1st November 2007, it was unanimously agreed to continue to fight the campaign on a legal front, challenging aspects of the Inspector's report and his recommendations which contained flaws. This will mean a comprehensive fund-raising campaign to raise the necessary legal fees to mount this challenge. Please give generously. If you don't wish to use Pay-pal - (see the front page) you can send a cheque made payable to "Save Radley Lakes" c/o The Treasurer, 3 Shaws Copse, Radley OX14 3GZ
The Planning Inspector's Report has been challenged by Mr. George Laurence, an eminent Barrister and as a result of this legal challenge Oxfordshire County Council delayed rubber stamping the Town Green Rejection until the meeting which took place on the 14th Jan 08. As predicted, the Rubber Stamp was applied. Save Radley Lakes fully intend to challenge this decision. Radley Parish Council have taken up the issue on behalf of the Community.
